Article 1 (Purpose)
These Terms and Conditions are intended to regulate the rights, obligations and responsibilities between the ‘Company’ and ‘Members’ in relation to the services provided by ROACORE GAMING PTY LTD (hereinafter referred to as the ‘Company’) using wired and wireless communication networks.

Article 2 (Definitions)
The definitions of terms used in these Terms and Conditions are as follows, and the interpretation of undefined terms shall follow the relevant laws and customs.
1. ‘Company’ refers to a person who provides services to members.
2. ‘Member’ refers to a person who accesses the game, agrees to these Terms and Conditions, and is granted the right to use the services provided by the ‘Company’.
3. ‘Account’ or ‘ID’ refers to a combination of letters or numbers set by a ‘Member’ and approved by the ‘Company’ for the purpose of identifying the ‘Member’ and using the service.
4. ‘Password’ refers to a combination of letters or numbers set by the ‘Member’ to confirm that he or she is a ‘Member’ and to protect the ‘Member’s’ account information.
5. Nickname information refers to general information including information entered or agreed upon when registering as a ‘Member’, and game information including the ‘Member’s’ service character, items, experience points, etc. 6. ‘Service’ refers to all digital content related to mobile games, including mobile game services provided by the ‘Company’ and items, game money, etc. (hereinafter referred to as ‘Items, etc.’) used in mobile games.
7. ‘Terminal’ refers to equipment such as mobile phones, PDAs, and portable game consoles that can download and use ‘Applications’.
8. ‘Application’ refers to a program configured to allow installation and use of ‘Services’ on mobile terminals.

Article 3 (Provision of Company Information, etc.)
The ‘Company’ shall post the following items on the ‘Company’ website or make them easily accessible to ‘Members’ through the link screen within the application.
1. Name of company and representative
2. Address of business location (including the address of the place where ‘Members’ complaints can be handled) and e-mail address
3. Telephone number, fax number
4. Business registration number, mail-order business report number
5. Personal information processing policy
6. Terms of service

Article 4 (Posting and Effectiveness of Terms and Conditions, etc.)
1. The ‘Company’ posts these Terms and Conditions on the ‘Company’ website or within the application that provides services to ‘Members’ so that ‘Members’ can easily recognize them.
2. These Terms and Conditions shall take effect on the effective date set forth in the supplementary provisions, and all ‘Members’ who use the ‘Services’ provided by the ‘Company’ shall be deemed to have agreed to these Terms and Conditions.
3. If there is reasonable cause, the ‘Company’ may change the contents of these Terms and Conditions to the extent that they do not violate relevant laws and regulations such as the ‘Act on Consumer Protection in Electronic Commerce, etc.’, the ‘Act on Regulation of Terms and Conditions’, the ‘Act on Promotion of the Game Industry’, the ‘Act on Promotion of Information and Communications Network Utilization and Information Protection’, and the ‘Content Industry Promotion Act’, and shall notify the ‘Members’ of the changed Terms and Conditions at least 7 days prior to the effective date. However, for matters that have a significant impact on the rights and obligations of ‘Members’, separate notice shall be given to ‘Members’ through electronic means 30 days prior to the effective date. 4. The ‘Member’ has the right not to agree to the revised terms and conditions, and may terminate the contract if he or she does not agree to the revised terms and conditions. However, if the ‘Member’ does not express his or her intention to reject the revised terms and conditions within a reasonable period of time as specified by the ‘Company’ upon notification to the ‘Member’, the revised terms and conditions shall be deemed to have been approved.
5. Matters not specified in these terms and conditions or their interpretation shall be governed by relevant laws or customary practices.

Article 5 (Establishment of Service Agreement)
1. The service agreement is concluded when a person wishing to use this ‘service’ installs and runs the application, agrees to the terms and conditions and personal information processing policy set by the ‘company’, applies for service use, and the ‘company’ approves such application.

2. The ‘company’ may not approve the application for use in the following cases:

①If the application for use contains false information or does not meet the application requirements
②If the service is used in an abnormal or roundabout way in a country where the company does not provide the service
③If the application for use is made for the purpose of committing an act prohibited by the relevant laws and regulations such as the ‘Act on the Promotion of the Game Industry’
④If the application is made for the purpose of disrupting the peace and order of society or public morals
⑤If the game service is to be used for an illegal purpose
⑥If the game service is to be used for the purpose of pursuing profit
⑦If approval is deemed inappropriate for any other reason similar to subparagraphs 1 through 6

3. The ‘Company’ may restrict applications for use in the following cases and may withhold approval until the cause is resolved:
① In the event of insufficient capacity of service-related facilities
② In the event of service-related disruptions or disruptions in service usage fees or payment methods
③ In the event that approval of applications for use is difficult due to other reasons similar to those listed above

Article 6 (Provision and Suspension of Services)
1. The ‘Service’ will commence immediately after the contract for use with the ‘Member’ is established. However, if the ‘Service’ cannot be commenced due to business or technical difficulties of the ‘Company’, this will be announced in the application or notified to the ‘Member’.
2. The ‘Service’ will be provided 24 hours a day, 365 days a year, in principle, unless there are special business or technical difficulties of the ‘Company’.
3. The Company may divide the ‘Service’ into certain areas and set separate availability times for each area, and in this case, the ‘Member’ will be notified of this fact through prior notice.
4. The ‘Company’ may temporarily suspend the ‘Service’ without prior notice or advance notice in the event of an urgent system inspection, expansion and replacement, maintenance inspection, equipment failure, communication outage, surge in ‘Service’ use, or other significant operational reasons.
5. The ‘Company’ may change the ‘Service’ it is providing according to operational or technical needs.

Article 7 (Member Account Management and Responsibility)
1. The ‘Member’ is responsible for managing the ‘Account’ and ‘Password’ used by the ‘Member’ while using this ‘Service’, and must not allow a third party to use them. If you become aware that your ‘Account’ and ‘Password’ have been stolen or are being used by a third party, you must immediately notify the ‘Company’ and follow the ‘Company’s’ instructions.
2. The ‘Member’ is responsible for all posts, including text and photos, posted on this ‘Service’. We are not responsible for any personal information of the ‘Member’, including accounts exposed due to the ‘Member’s’ fault.
3. The intellectual property rights of all characters, items, and other data in the game, including text and photos written by the ‘Company’, belong to the ‘Company’. 4. ‘Members’ must not engage in acts that harm public morals or social order or infringe upon the rights of others while using this ‘Service’, and must not post, transmit, or distribute any information or postings that contain viruses, adware, spyware, etc. or that infringe upon the intellectual property rights of third parties, including copyrights. All responsibility for this lies with the ‘Member’.
5. In the event of a violation of Article 4, the ‘Company’ may delete or refuse to register such postings without prior notice or consent from the ‘Member’, and the ‘Company’ shall not be held liable for such postings.

Article 8 (Collection of Information)
1. The ‘Company’ may collect and use chat contents between ‘Members’ in order to provide smooth services. The ‘Company’ will allow access to this information only when it deems it necessary for the purpose of mediating disputes between ‘Members’, handling complaints, or maintaining game order. This information is held only by the ‘Company’ and cannot be accessed by others who are not authorized by law.
2. The ‘Company’ may collect and use the terminal settings and specifications of ‘Members’ in order to improve service quality, such as service operation and program stabilization.
3. The ‘Company’ may request additional information about ‘Members’ for the purpose of improving services and introducing services to ‘Members’, and ‘Members’ may accept and provide additional information or refuse such requests.

Article 9 (Protection and Use of Personal Information)
1. The ‘Company’ strives to protect the personal information of ‘Members’ in accordance with the relevant laws and regulations, and the protection and use of personal information shall be governed by the relevant laws and regulations and the ‘Company’s’ personal information processing policy. However, the ‘Company’s’ personal information processing policy shall not apply to linked services other than the ‘Company’s’ official game service and site.
2. The ‘Company’ shall not provide the ‘Member’s’ personal information to others without the ‘Member’s’ consent, except in cases where there is a request from a relevant government agency, etc. in accordance with relevant laws and regulations.
3. The ‘Company’ shall be exempt from liability for damages related to the use of the service resulting from the leakage of personal information due to the ‘Member’s’ fault.

Article 10 (Contract Termination and Restrictions on Use)
1. If a ‘Member’ falls under any of the following items, the ‘Company’ may terminate the contract with the ‘Member’ without prior notice or suspend part or all of the ‘Member’s’ use of this ‘Service’ for a certain period of time, and delete the relevant posting without prior notice. ① When distributing information that violates public order or morals
② When insulting or damaging the reputation of others
③ When infringing on the copyright, intellectual property rights, or other rights of the ‘Company’ or a third party
④ When violating relevant laws or regulations or being judged to be related to a crime
⑤ When distributing computer viruses or attempting hacking, and repeatedly posting or transmitting certain content such as advertising information
⑥ When impersonating others or illegally using another member’s account
⑦ When collecting, stealing, storing, or distributing another member’s personal information
⑧ When disrupting social order by posting obscene materials or linking to or distributing obscene websites
⑨ When forging or altering posts or materials posted on the ‘Service’
⑩ When stalking or harassing others
⑪ When transferring or selling your account to another person
⑫ When repeatedly signing up and withdrawing without a justifiable reason, causing disruption to the operation of the ‘Company’s’ service
⑬ Any act that disrupts or is likely to disrupt the operation of the ‘Service’, or other acts In the event of an act that violates the relevant laws and regulations
2. Regardless of whether a specific act falls under any of the above items, the ‘Company’ may take appropriate disciplinary measures, including suspension of use of the ‘Service’ or deletion of an account, if necessary for the safe operation of the ‘Service’ of the ‘Member’, and has the right to modify the above example items at any time.

3. If a ‘Member’ whose contract has been terminated according to the above items reapplies for use, the ‘Company’ may restrict or reject the approval for a certain period of time.
4. A ‘Member’ may withdraw from membership only through the ‘Withdrawal Request’ function within the game.

5. If a ‘Member’ withdraws from this ‘Service’, all information and posts within the ‘Service’ except for the ‘Member’s’ ‘Account Name’ will be immediately deleted.

Article 11 (Procedures for Objection to Restrictions on Use)
1. If a ‘Member’ wishes to object to the ‘Company’s’ restrictions on use, he/she must submit an objection application stating the reason for objection to the ‘Company’s’ restrictions on use to the ‘Company’ in writing, by e-mail, or by a similar method within 15 days from the date of receiving the notice.
2. Upon receiving the objection application in Paragraph 1, the ‘Company’ must respond to the ‘Member’s’ reasons for objection in writing, by e-mail, or by a similar method within 15 days from the date of receipt. However, if the ‘Company’ is unable to respond within 15 days, it shall notify the ‘Member’ of the reason and processing schedule.
3. The ‘Company’ must take corresponding measures according to the content of the above response.

Article 12 (Obligations of the Company)
1. The ‘Company’ shall comply with relevant laws and regulations and faithfully perform the exercise of rights and performance of obligations stipulated in these Terms and Conditions in good faith.
2. If the opinions or complaints raised by the ‘Member’ are objectively recognized as justified, the ‘Company’ shall promptly process them within a reasonable period of time. However, if the processing takes a long time, the ‘Member’ shall be separately notified of the reason and processing schedule.
3. If a service failure occurs, the ‘Company’ shall make every effort to repair or restore it without delay unless there is an unavoidable reason.
4. The ‘Company’ shall endeavor to provide convenience to the ‘Member’ in procedures and contents related to the contract with the ‘Member’, such as the conclusion of the service agreement, changes to the contract terms, and termination.

Article 13 (Member Obligations)
1. ‘Members’ must provide accurate information when applying for use or making changes.
2. ‘Members’ must comply with relevant laws, regulations of these Terms and Conditions, usage instructions and notices posted on the service, and matters notified by the ‘Company’, and must not engage in any other acts that interfere with the ‘Company’s’ business.
3. ‘Members’ may not engage in any commercial activities using this ‘Service’ without the ‘Company’s’ prior consent, and may not distribute or post materials that violate the law.
4. ‘Members’ are responsible for maintaining and managing their own accounts and passwords, and the ‘Company’ shall not be held liable for any consequences resulting from the leakage of their own accounts or passwords.
5. ‘Members’ may not copy, reproduce, modify, translate, publish, broadcast, advertise, sell, transmit, or use in any other way the information obtained through the ‘Service’ without the ‘Company’ or the publisher’s prior consent, or provide such information to others. 6. ‘Members’ may not infringe upon the copyrights or intellectual property rights of the ‘Company’ or other third parties.

Article 14 (Provision of Information and Publication of Advertisements)
1. In addition to the ‘Member’ information provided through the platform operator or app store operator, the ‘Company’ may request additional information from the ‘Member’, and the ‘Member’ information collected or provided will not be used for purposes other than those specified in the Personal Information Processing Policy.
2. The ‘Company’ may provide various information, including advertisements, to the ‘Member’ through notices, push services, SNS messages, etc., and the ‘Member’ may refuse to receive such information at any time by using the rejection function within the application.
3. In the case of notification to an unspecified number of ‘Members’, the ‘Company’ may replace individual notifications by posting on the initial screen of this ‘Service’ for more than 7 days.
4. The ‘Company’ may post advertisements, etc. on the service screen, etc. in locations designated by the ‘Company’ in relation to the operation of this ‘Service’, and the ‘Member’ agrees to the advertisements being displayed when using the service.
5. The ‘Member’ may not arbitrarily delete, defame, or otherwise interfere with advertisements provided by the ‘Company’. 6. The ‘Company’ may promote the promotional activities of advertisers posted on this ‘Service’ or through this ‘Service’, and shall not be liable for any losses or damages incurred by ‘Members’ accessing, participating in, or transacting with advertisements.

Article 15 (Purchase of Paid Content)
1. ‘Members’ may purchase paid content in accordance with the payment operation policy of each app store operator according to the type of terminal they are using the service on, and differences in the payment policy may result in differences in the payment amount. In addition, the purchase price of paid content is charged in accordance with the method and policy determined by the app store operator or the mobile carrier or platform operator (hereinafter referred to as “payment company”) affiliated with the app store operator, and the payment method also follows the policy of the relevant operator.
2. Paid content purchased by ‘Members’ within the game service can only be used on the terminal where the game service application has been downloaded and installed.
3. The usage period of paid content purchased by ‘Members’ is basically 1 year from the date of purchase, and if this period expires, ‘Members’ lose the right to use the paid content. However, in the case of paid content with a usage period separately specified, the usage period specified at the time of purchase shall apply. ‘Members’ may only use paid content through their ‘Member’ account, except in the manner separately notified by the ‘Company’, and may not transfer, rent, sell or exchange such content to third parties.

Article 16 (Payment)
1. In principle, the purchase price for content is charged according to the policies and methods set by the payment company (app store operator, mobile carrier, platform operator, etc.), and payment must also be made according to the set method. The limit may be imposed or adjusted for each payment method depending on the policies of the ‘Company’ and the payment company, government policy, etc.
2. The ‘Company’ shall not be held responsible for any third-party payments that occur due to the ‘Member’ not using the terminal and open market password setting function, etc. or due to careless exposure.
3. When paying in foreign currency, there may be a difference between the expected payment amount and the actual billing amount due to the exchange rate and purchase store fees.

Article 17 (Cancellation of subscription and refund of purchase price, etc.)
1. ‘Members’ may cancel subscription (cancel purchase) without additional fees within 7 days from the contract date or the date of availability of paid content. However, subscription cancellation (cancellation of purchase) may be restricted in accordance with relevant laws for some paid content with similar characteristics, such as paid content provided free of charge by the ‘Company’ or a third party, such as gifts and events, paid content that has already been used or is deemed to have been used at the time of subscription cancellation request. In this case, the ‘Company’ will take measures in accordance with relevant laws, such as notifying the ‘Member’ when purchasing the paid content.
2. Subscription cancellation of paid content is restricted in the following cases, and the ‘Company’ will indicate that subscription cancellation is restricted before payment for paid content for which subscription cancellation is restricted. ① In the case of items that are used immediately after purchase or are immediately applied to the application
② In the case of items acquired without payment during the normal use of the application
③ In the case of items that provide additional benefits, when the additional benefits are used
④ In the case of some of the items sold in a bundled form being used
⑤ In the case of items that are difficult to resell after time has passed
⑥ In the case of capsule-type/probability-type items where the act of opening can be considered use or the utility is determined upon opening
⑦ In the case of game items, etc. that have already been used or are considered to have been used according to these Terms and Conditions and the notice given at the time of purchase
⑧ In other cases prescribed by law for the safety of transactions
3. Refunds are processed according to the refund operation policy of each app store operator depending on the type of operating system of the terminal using the ‘Service’.
4. In the case of requesting cancellation of subscription and refund, etc., the process is carried out by going through a separate personal information handling consent process through the ‘Company’ customer center and then confirming the purchase history of the ‘Company’. During this process, the process is carried out after going through the procedure of confirming the purchase history through the payment company. During this process, the ‘Company’ may contact the ‘Member’ to confirm the exact facts using the information provided by the ‘Member’ if necessary to verify the legitimate reason for the ‘Member’s’ withdrawal, and may request additional proof.
5. If a minor has paid for paid content sold in the application without the consent of the legal representative, the minor or the legal representative may request withdrawal of subscription. However, if the minor’s payment for paid content is within the scope of property that the legal representative has permitted to dispose of, or if the minor has used fraud, etc. to make the minor believe that he or she is an adult, withdrawal of subscription is restricted. Whether the purchaser of paid content is a minor is determined based on the name of the terminal or payment method such as credit card through which the payment was made. If a minor requests cancellation of payment, documents proving the minor and legal representative must be submitted as required by the ‘Company’. 6. In principle, subscription cancellation is not possible for paid content payments made through the gifting function, except in cases where there is a defect in the purchased paid content. Refunds due to defects in the paid content are only available to the ‘member’ who sent the gift.
7. The ‘company’ will endeavor to complete the refund as soon as possible from the date of receipt of the relevant documents required for subscription cancellation from the ‘member’.

Article 18 (Effect of subscription cancellation, etc.)
If the ‘company’ receives a return of paid content, etc. from the ‘member’, it will notify the payment company of the refund confirmation within 3 business days so that the refund process can proceed immediately. Thereafter, the refund process will be carried out by the payment company in accordance with relevant laws.

Article 19 (Refund of Overpayment)
1. If an overpayment occurs due to the ‘Company’s’ intention or fault, the overpayment will be refunded to the ‘Member’. However, if an overpayment occurs due to the ‘Member’s’ intention or fault, the ‘Member’ will be responsible for the cost incurred by the ‘Company’ in refunding the overpayment within a reasonable range.
2. Payment through the application follows the payment method provided by the app store operator. Therefore, if an overpayment occurs during the payment process, a refund must be requested from the app store operator in principle. However, if possible, depending on the app store operator’s policy or system, the ‘Company’ may request the app store operator to perform the necessary refund procedures.
3. Fees incurred by downloading the application or using network services (call charges, data call charges, etc.) may be excluded from the refund.

Article 20 (Contract Termination and Service Suspension)
1. If a ‘Member’ does not wish to use an individual ‘Service’ at any time, he/she may terminate the service agreement by withdrawing from the individual service.
2. If a ‘Member’ requests withdrawal from an individual ‘Service’, all information, including the ‘Member’s’ service usage history and paid/free content, will be deleted, so the ‘Member’ must request a refund for paid content before withdrawing from the individual service. In addition, if a ‘Member’ requests withdrawal from an individual ‘Service’, the relevant service cannot be used for 2 weeks (14 days) after withdrawal.
3. If a ‘Member’ violates the provisions of Article 10 or the ‘Service’ operation policy, the ‘Company’ may terminate the service agreement or restrict the ‘Service’ use for a specified period.
4. A ‘Member’ may file an objection to the ‘Service’ use restriction pursuant to Paragraph 3 in accordance with the procedures set by the ‘Company’, and if the ‘Company’ determines that the ‘Member’s’ objection is justified, the ‘Service’ use will be resumed immediately.
5. The ‘Company’ shall not be liable for damages suffered by the ‘Member’ due to the ‘Service’ usage restriction in accordance with Paragraph 3, if the restriction on the ‘Service’ usage is justified.
6. The ‘Company’ may restrict the usage method, usage time, usage frequency, etc. to prevent the ‘Member’ from being overly immersed in the service, and may apply the ‘Member’ protection program depending on the degree of the ‘Member’’s’ over-immersion in the service. If the ‘Member’ refuses to apply the ‘Member’ protection program, the ‘Company’ may discontinue the service provision regardless of the ‘Member’s’ will.

Article 21 (Compensation for Damages)
1 The ‘Company’ shall be liable for damages suffered by the ‘Member’ due to the ‘Company’’s’ intentional or gross negligence in using the ‘Service’. 2. If a ‘member’ violates the obligations of these Terms and Conditions and causes damage to the ‘company’ or if a ‘member’ causes damage to the ‘company’ while using the ‘service’, the ‘member’ must compensate the ‘company’ for the damage.
3. If a ‘member’ violates the obligations of these Terms and Conditions and causes damage to the ‘company’ or if a ‘member’ causes damage to the ‘company’ while using the ‘service’, the ‘member’ must compensate the ‘company’ for the damage.
4. If a ‘member’ receives a claim for damages or a lawsuit or other objection from a third party other than the ‘member’ due to an illegal act committed during the use of the ‘service’ or a violation of these Terms and Conditions, the ‘member’ must indemnify the ‘company’ at his/her own responsibility and expense, and if the ‘company’ suffers damage due to the ‘company’ not being indemnified, the ‘member’ must compensate for the damage.

Article 22 (Exemption Clause)
1. If the ‘Company’ is unable to provide the ‘Service’ due to a natural disaster or other force majeure, the ‘Company’ shall be exempt from liability for providing the ‘Service’.
2. The ‘Company’ shall not be liable for any disruption in the use of the ‘Service’ due to the fault of the ‘Member’, and shall not be liable for any damages incurred to the ‘Member’ due to the suspension or failure to normally provide telecommunications services by the telecommunications service provider.
3. The ‘Company’ shall not be liable for the reliability, accuracy, etc. of the information, data, and facts posted by the ‘Member’ in relation to the ‘Service’.
4. The ‘Company’ shall not be liable for any failure by the ‘Member’ to obtain the expected scores, rankings, etc. by using the ‘Service’, and shall be exempt from liability for any damages incurred due to the selection or use of the ‘Service’.
5. The ‘Company’ shall not be liable for any disputes, etc. that arise between ‘Members’ or between ‘Members’ and third parties through the ‘Service’. 6. The ‘Company’ shall not be liable for the use of content acquired as compensation during the game ‘service’ without payment of usage fees, or provided by the ‘Company’ through internal events or external affiliate events, unless otherwise specifically provided for in relevant laws.
7. In the case of free ‘services’ or free content among the ‘services’ provided by the ‘Company’, they are excluded from compensation for damages. However, damages caused by the ‘Company’s’ intention or negligence are excluded.

Article 23 (Dispute Resolution)
1. The ‘Company’ shall provide guidance on how to present opinions or complaints of ‘members’ on the game’s settings screen or the ‘service’ homepage for the convenience of ‘members’. The ‘Company’ shall appropriately and promptly process opinions or complaints raised by ‘members’ and notify the results. However, in cases where prompt processing is difficult, the ‘Company’ shall notify the ‘members’ of the reason and processing schedule through notices within the service or by e-mail, phone, or in writing.

3. ‘Members’ can submit the following items to the customer center.
① General business related to use, such as application for termination of service agreement and objection to use restriction, etc.
② General business related to game, such as receiving inquiries and improvement requests related to game, etc.

Article 24 (Jurisdiction and Governing Law)
These Terms and Conditions shall be interpreted in accordance with the laws of the Republic of Korea, and in the event of a lawsuit arising from a dispute between the ‘Company’ and the ‘Member’, the court with jurisdiction shall be the court in accordance with the procedures set forth in the law.
